General conditions of sale

These general terms and conditions of sale are entered into between, on the one hand:

Internet users who wish to make a purchase on the "Star Jersey Shop" website, available at the following address: https://starjerseyshopcom/, hereinafter referred to as "the Customer".

These terms and conditions govern the sale of any product presented on the Star Jersey Shop website by Star Jersey Shop SAS. The parties agree that their relationship will be governed exclusively by this contract, to the exclusion of any other conditions.
The items are only offered for sale to non-commercial individuals. They are entered into intuitu personae and therefore cannot be assigned, of any nature whatsoever.
Any order duly validated on the Star Jersey Shop website implies full and unreserved acceptance of these general terms and conditions of sale and, where applicable, of any special or specific conditions applicable to one or more products or orders.

1. PURPOSE

These terms and conditions are intended to define the mutual obligations of the parties as well as the various stages of the ordering process.

2. ITEMS

Star Jersey Shop is a website dedicated to offering sports-related clothing and accessories for sale.

The items visible on the website are available while stocks last. Consequently, Star Jersey Shop SAS does not guarantee that the products will remain available for sale for a given period. Any customer complaint regarding the order or delivery of an unavailable item will be considered unfounded.
In the event of a validated order for a product or item that becomes unavailable, Star Jersey Shop SAS undertakes not to cash the check sent by the customer. In the event of a payment being made for an order for an unavailable item, Star Jersey Shop SAS undertakes to reimburse the customer for the amount of the order by bank transfer within 15 days of receiving a bank account details form.
In all cases, Star Jersey Shop SAS undertakes to notify any customer who has ordered an unavailable item by email.

3. DELIVERY

Star Jersey Shop SAS works in collaboration with La Poste and its Colissimo service as well as with the Chronopost delivery service to offer the Customer fast, high-quality deliveries. An email containing the tracking number of the carrier in charge of the package (Colissimo or Chronopost) is sent to the customer as soon as their package is shipped.

Delivery is made within a maximum of 10 business days throughout France. For other international destinations, delivery times are 14 to 15 business days. These times are indicative, and any delays cannot give rise to compensation or refusal of the package. Please note that all "shipping time" terms found on the website are always expressed in business days. In addition, an additional two business days is applied if you add a marking.

Standard delivery of your order is provided by Colissimo without a signature. Deliveries to a Relay Point require the recipient's signature. Finally, deliveries with Chronopost are also subject to signature required, both in France and internationally.

Shipping costs are calculated based on the amount, weight, and destination country of the Customer's order. They include processing, packaging, and shipping of the products.

Star Jersey Shop ID SAS delivers its products to mainland France, overseas territories, Europe, the United States, Australia, and around ten countries in Asia.

4. ORDER

Customers interested in items displayed on the Star Jersey Shop website follow this process to place their order:

  • They add their products to their cart.

  • If they benefit from a special offer, they must enter their assigned promo code in the field provided.

  • They check the details of their order (color, quantity, price, etc.) and confirm their order. Cart

  • He enters his contact information (which will be pre-filled on his next visit): first name, last name, billing and delivery addresses, etc.

  • He chooses his payment method (check, credit card, PayPal)

  • He checks his order and information one last time and confirms his order

  • He can then complete his Payment

Any order placed will be confirmed to the buyer by sending an order confirmation (in accordance with the provisions of Article L121-19 of the French Consumer Code) as soon as possible by email, if this has been correctly provided by the buyer when entering their contact details.

5. PAYMENT

Orders placed through one of the three procedures presented below are irrevocably binding on the buyer.

6. RETURN / WITHDRAWAL / REFUND

All returns must be reported to our customer service at info@starjerseyshop.com. All items must be returned in their original packaging with their label intact and in the condition they received it.

Any personalized item cannot be returned, exchanged, or refunded.

No returns by express parcel will be accepted, regardless of the reason.

If the delivered product matches the customer's order, all return costs will be at the customer's expense.

If the product is defective or does not match the order, we will refund the customer. Return shipping costs (only upon presentation of an invoice proving payment). The maximum amount reimbursed for shipping costs is €8. All refunds will be issued within 14 business days.

For any item returned with the reason 'defective', the Customer must specify the nature of the defect in a separate letter.

Star Jersey Shop SAS will cover the costs incurred for reshipping the products.

Once orders are being prepared, they cannot be canceled. No order can be canceled if it includes one or more personalized items.

Regarding exchanges, they will take between 10 and 15 days, given that many of our products are imported. If one of the products to be exchanged remains out of stock for more than 60 days, you will receive a refund.

We make every effort to provide quality service to all our customers. However, if the quality of an ordered product is questionable, we reserve the right to return the product to the original manufacturer for inspection before making any decision regarding the product in question.

7. WARRANTY

- WARRANTY - SCOPE

The products benefit from the legal guarantee of conformity pursuant to Article L211-4 of the French Consumer Code. The products benefit from the legal guarantee against hidden defects arising from a defect in the material, design or manufacturing affecting the products and making them unfit for use, pursuant to articles 1641 et seq. of the Civil Code. The products benefit from the warranties provided by the product manufacturers, according to the latter's specifications.

In order to assert their rights, the customer must, under penalty of forfeiture of any related action, inform the seller of the existence of defects, by registered letter with acknowledgment of receipt within the time limits provided for in Articles L211-12 of the Consumer Code and Article 1648 of the Civil Code.

- WARRANTY - EXCLUSION

The buyer will lose the benefit of legal and conventional warranties, particularly in the event of:
abnormal or abusive use of the goods;
repairs or any work carried out by persons unrelated to the seller or not authorized by the seller or the manufacturer, or if these interventions have not followed the instructions;
The seller may suspend the legal and conventional warranties in the event of late or non-payment of all or part of the price of the goods.

- WARRANTY - LIMITS

The seller's liability is limited to the repair or replacement of goods recognized as defective or containing a manufacturing, labeling, or packaging defect. The seller's services will have the opportunity to investigate the alleged defects. All other express or implied warranties are excluded. No liability will be accepted for loss or damage, direct or indirect, whatever the cause. Under no circumstances may the buyer claim, for any reason whatsoever, to withhold any amount from invoices corresponding to incomplete delivery or for defective goods.

8. SIGNATURE AND PROOF

Validation of the order, by its payment, constitutes signature and express acceptance of all transactions carried out on the site. However, the due date for the amounts due is that referred to in Article 4.2, depending on the type and method of payment.

9. LIABILITY

For all stages of accessing the website, browsing, completing forms, placing orders, delivering items, or providing any other service, Star Jersey Shop SAS has only an obligation of means. Consequently, Star Jersey Shop SAS cannot be held liable for any inconvenience or damage inherent in the use of the internet and completely outside the due diligence and precautions taken by Star Jersey Shop SAS. In particular, any disruption in the provision of the service, or any external intrusion or presence of a computer virus, cannot incur the liability of Star Jersey Shop SAS.
Similarly, any event classified as force majeure within the meaning of the case law of the Court of Cassation completely exonerates Star Jersey Shop SAS from any liability.

10. ENTIRE AGREEMENT

These terms and conditions, entered into between Star Jersey Shop SAS and the customer, express the entirety of the parties' obligations. No information or document may create obligations under these terms and conditions unless they are the subject of an amendment signed by both parties. No correspondence prior to the signing of this contract may create obligations under said contract.
However, if a condition is missing, it will be considered to be governed by current practices in the sales sector.

11. TOLERANCE OR WAIVER

It is formally agreed between Star Jersey Shop SAS and the customer that any tolerance or waiver by either party in the application of all or part of the commitments set out in these terms and conditions, regardless of the frequency or duration, shall not constitute a modification of this agreement or create any right whatsoever.
More specifically, no delay, inaction, abstention, or omission on the part of the customer in exercising any of their rights under this agreement shall affect said right, nor shall it be considered as implying a waiver on their part to exercise this right.

12. PARTIAL INVALIDITY

If a particular provision of these terms and conditions is held to be invalid or declared as such by a decision having the force of res judicata of a competent court, the other provisions shall retain their full force and effect.
